The following terms and conditions (“Terms”) govern the use of all services provided by Castimize. These Terms may be updated or revised at any time, at Castimize’s sole discretion. Continued use of our services after any such update or revision constitutes acceptance of the new Terms. It is your responsibility to regularly check this section for the latest version. No prior notice of changes is required, and no disclaimer will limit the binding nature of the updated Terms.
Process & Service
These Terms govern your use of Castimize services, including but not limited to our website, user portal, and any related services. By using Castimize, you agree to comply with all applicable laws and regulations. You must be at least 18 years old or have obtained verifiable parental or guardian consent to use our services.
Castimize enables you to upload 3D models for manufacturing, and we will fulfill the order and ship it to your specified address for a fee. You acknowledge and agree that Castimize will fulfill your order based on the mutually agreed-upon material, design, and timeline specifications. Any variations due to manufacturing limitations will be communicated and do not constitute a breach of contract.
Pricing
All prices are subject to change at any time without prior notice. However, orders that have been confirmed and paid will not be affected by price changes. Prices are influenced by a variety of factors, including market conditions and material costs, some of which are beyond Castimize’s control, such as the prices of raw commodities or logistical constraints. Castimize reserves the right to update pricing without liability or notice.
Expected Delivery time
Lead times are calculated based on current conditions and are subject to change. During peak periods or due to unforeseen circumstances, delivery times may be adjusted. However, Castimize will make every reasonable effort to meet the expected delivery date provided at the time of order.
Payment
All payments must be made through our authorized payment platform. By placing an order, you agree to be bound by our payment terms and authorize Castimize to charge the full amount to your selected payment method. Castimize will only commence production once payment has been confirmed. It is your responsibility to ensure that your billing information is accurate and up-to-date. Failure to maintain accurate billing details may result in delays, and Castimize disclaims all liability for such delays. Order confirmations are available in your account, and shipping details will be sent via email.
For Paid Services, by providing payment information, you confirm that you are authorized to use the provided payment method, and you agree to pay all applicable charges associated with the services.
Models, File Ownership & Intellectual Property
All uploaded 3D models and designs remain the intellectual property of the original uploader. Castimize does not claim any ownership of your designs. We will store your model file solely for the purpose of fulfilling your order, and no additional rights are granted to Castimize. By uploading, you represent and warrant that you own the intellectual property rights to the model or have obtained necessary rights or permissions for its use.
You agree that any legal responsibilities or liabilities arising from intellectual property infringements related to the uploaded model rest solely with you, the user. Castimize will not be responsible for verifying the ownership or legality of the uploaded content.
Once a model is removed from our platform, Castimize’s only continued use of the model will be to fulfill any existing, uncompleted orders.
Orders & Cancellations
Orders may be canceled due to manufacturing or file-related issues, violations of policy, or failure to meet content compliance standards. In such cases, refunds will be issued when applicable. However, once production begins, orders cannot be canceled, amended, or refunded. If a model violates content policies, Castimize reserves the right to reject the order. Refunds in these cases will depend on the timing and nature of the violation discovery.
Warranties
Castimize warrants that the manufactured product will substantially match the uploaded 3D model, within the inherent limitations of the manufacturing process. Variations due to the casting process or human post-processing may occur, and these will not be considered defects. You bear full responsibility for ensuring that the design and specifications of your uploaded model meet your desired functional and aesthetic standards. Castimize disclaims any responsibility for the performance or usability of the final product beyond the physical production itself.
Castimize provides no warranty, express or implied, with respect to the design or functionality of the 3D models you submit. Additionally, Castimize disclaims any implied warranties of fitness for a particular purpose, title, or non-infringement.
Returns, Refunds & Replacements
Upon receiving your order, you must inspect the product for any defects or non-conformities within 10 days. If the product is defective and reported within this time frame, a refund or replacement may be issued at Castimize’s discretion. Any alteration, modification, or post-processing performed on the model by the customer will void any warranty or eligibility for replacement. Castimize will not be responsible for defects arising from user modifications.
Disclaimer of Warranties & Limitation of Liability
The services and content provided by Castimize are offered “as is” and “as available” without any guarantees regarding their security, availability, or the correction of defects. Castimize expressly disclaims all warranties, whether express or implied, including but not limited to warranties of title, non-infringement, merchantability, and fitness for a particular purpose. You assume full responsibility for the selection and use of materials in your model.
In no event will Castimize, its affiliates, or its employees be liable for any direct, indirect, incidental, or consequential damages arising from your use of Castimize services or products, including but not limited to errors in the manufacturing process, loss of profits, or data breaches. Castimize shall not be liable for any events outside its control, including force majeure events such as natural disasters, government actions, or unforeseen supply chain disruptions.
Data Collection & Usage
By using Castimize services, you consent to our collection and use of your personal data for service optimization, customer support, order fulfillment, and communications regarding your orders or promotional activities related to Castimize. We do not share your personal data with third parties for purposes beyond what is necessary for service fulfillment, unless required by law. For more information, please see our Privacy policy.
Legal Notes & Dispute Resolution
These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of Castimize services will be resolved exclusively in the courts of Amsterdam. These Terms are personal to you and cannot be assigned or transferred without Castimize’s written consent.
Indemnification
You agree to indemnify, defend, and hold harmless Castimize, its affiliates, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses arising from your use of Castimize services, including but not limited to violations of intellectual property rights, legal regulations, or third-party rights.
